Terms of service

The online store www.klap.ee (hereinafter referred to as the “Online Store”) is owned by PopUp OÜ (registration code 14013302), located at Vana-Lõuna 39a, Tallinn.

Validity of the Sales Agreement, Product and Price Information

The terms and conditions apply when purchasing goods from the Online Store.

Prices for products sold in the Online Store are displayed next to the products. An additional fee for the delivery of goods is added to the price. All prices in the Online Store are in euros.

The delivery fee depends on the buyer’s location and the delivery method chosen. The delivery fee is shown to the buyer when placing the order.

Information about the goods is provided directly next to the products in the Online Store.

Placing an Order

To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in, and a suitable delivery method must be selected. The total amount, including delivery fees, will then be displayed on the screen. The amount can be securely paid using the following payment methods:

  • Visa/Mastercard/Amex credit card payment

NB: When paying via bank link, make sure to click the “Return to merchant” button on the bank’s page.

Payments are processed by Montonio. Payments take place in a secure environment—payments via bank link occur in the secure environment of the respective bank, and payments by credit card are processed in the secure environment of Montonio. The seller does not have access to the buyer’s banking or credit card details. The contract is deemed valid once the total amount due has been received in the Online Store’s bank account.

The owner of the Online Store is the data controller responsible for processing personal data and will transfer the necessary personal data to Montonio, the authorized data processor, to execute payments.

If the ordered goods cannot be delivered due to stock depletion or other reasons, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded immediately, but no later than within 14 days of the notification.

Delivery

Goods are shipped to the following countries: all European Union countries.

The buyer has the following delivery options:

  • Delivery to the address provided by the buyer;
  • The option to pick up the goods personally.

The delivery costs are borne by the Online Store, and the respective pricing information is displayed next to the delivery method.

Domestic deliveries within Estonia generally reach the buyer’s designated destination within 10 working days from the conclusion of the sales agreement. Deliveries outside of Estonia will be made within 14 calendar days.

In exceptional cases, delivery may take up to 45 calendar days.

Right of Withdrawal

The buyer has the right to withdraw from this contract within 14 days without providing any reason. The right of withdrawal does not apply if the buyer is a legal entity.

The withdrawal period expires 14 days after the buyer or a third party, other than the carrier, has physically received the goods.

To exercise the right of withdrawal, the buyer must inform PopUp OÜ of their decision to withdraw from the contract by sending an unequivocal statement (e.g., an email to info@klap.ee). The buyer can also fill out and submit the standard withdrawal form or any other clear statement electronically on our website www.klap.ee, using the form provided below. If the buyer uses this option, we will promptly send a confirmation of receipt of the withdrawal notice via a durable medium (e.g., by email).

To meet the withdrawal deadline, it is sufficient for the buyer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If the buyer withdraws from this contract, we will reimburse all payments received from the buyer, including delivery costs (except for additional costs resulting from the buyer’s chosen delivery method that differs from our least expensive standard delivery option), without undue delay, and no later than 14 days from the day we are informed about the buyer’s decision to withdraw from this contract. We will make such reimbursements using the same payment method that the buyer used for the original transaction, unless the buyer has expressly agreed otherwise; in any case, the buyer will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or the buyer has provided proof of returning the goods, whichever is earlier.

The buyer must return the goods promptly and no later than 14 days from the day they notified us of the withdrawal from this contract. The deadline is met if the buyer returns the goods before the 14-day period expires. The buyer bears the direct cost of returning the goods.

The buyer is only liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics, and functioning.

Right to Submit a Complaint

The Online Store is responsible for any non-compliance or defects present at the time of delivery of the goods to the buyer that manifest within two years of the handover. For one year following the handover, it is presumed that the defect was present at the time of delivery. The Online Store is responsible for proving otherwise.

The buyer must notify the Online Store of any defects no later than two months after the defect has been discovered by sending an email to info@klap.ee.

The Online Store is not liable for defects that arise after the goods have been handed over to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all payments made under the sales contract.

The Online Store will respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.

Direct Marketing and Personal Data Processing

The Online Store uses the personal data entered by the buyer only for processing the order and delivering the goods to the buyer. The Online Store will forward personal data to transport service providers to deliver the goods.

The Online Store will send newsletters and offers to the buyer’s email address only if the buyer has expressed a desire to receive them by entering their email on the website and indicating their wish to receive direct marketing messages.

The buyer can opt out of receiving promotional emails at any time by notifying us via email or following the instructions provided in the promotional email.

Dispute Resolution

If the buyer has any complaints regarding the Online Store, they should be sent to the email address info@klap.ee.

If the buyer and the Online Store cannot resolve the dispute through negotiation, the buyer may refer the matter to the Consumer Disputes Committee. The terms of the procedure and application forms can be found hear.

The Consumer Disputes Committee is competent to resolve disputes arising from a contract between the buyer and the Online Store. The buyer’s complaint will be reviewed by the committee free of charge.

The buyer may also refer the matter to the European Union’s Online Dispute Resolution platform.
